Dog-walkers in Hayle could soon be stopped by police and enforcement officers and asked to prove they are carrying waste bags. Hayle Town Council has decided to ask Cornwall Council to amend its dog control order to give officers the power to check if dog-owners have bags on them, after a local resident complained that dog mess was a big problem in the town. Paul Pellegrinetti told councillors that he regularly steps in dog mess while walking around the town and asked if something could be done about the issue.

    “The police do not have the power to stop and search dog walkers for pooh bags. I don't know where this story has originated from, but it is utterly ridiculous. If ANY dog owners are stopped and police - or anybody else- tries to search you for pooh bags - I suggest you refuse to comply. And then, report them to the Police Complaints Authority.

    A police officer has powers to stop and search you if they have 'reasonable grounds' to suspect you're carrying:

    illegal drugs
    a weapon
    stolen property
    something which could be used to commit a crime, eg a crowbar

    You can only be stopped and searched without reasonable grounds if it has been approved by a senior police officer. This can happen if it is suspected that:

    serious violence could take place
    you're carrying a weapon or have used one
    you're in a specific location or area

    I suggest that this story is just ridiculous and has no basis in fact.”

    “What a load of nonsense. What happens if a pet owner takes Rover out for a walk, does their duty and pick up the dogs mess with a bag they've taken with them, then later in the walk the local stasi come play hitler and ask the owner to prove they have a bag, only to be told it's already been used?

    I've got an idea for Mr. Pellegrinetti, pop along to Specsavers, not sure if there is one in Hayle, or use a different opticians, and ask them if they can help you see where you are walking.”
