Lanner Parish Council's fight to limit the number of new homes is not over
LANNER parish council has instructed its lawyers to seek permission to appeal against a recent a High Court judgement.
Last month the court rejected the authority's attempt to quash planning permission granted by Cornwall Council to build 25 affordable homes in the village.

The parish council argued its own parish plan had identified a need for only 11 affordable homes in the village, and that Cornwall planners should have given more weight to a document, H20, which limited the number of affordable homes on such small 'exception' sites to 12.
However Judge Anthony Thornton, QC, rejected the appeal on both counts, accepting that the need for social housing was far higher than the parish council's estimate.

Following the decision the parish council has instructed its legal team to seek leave to appeal against it.
The chairman of Lanner Parish Council's planning committee, councillor Chris Martin, said: "We did not agree with the judgement on the judicial review because it resulted in a situation which affects not just this parish but a large number of parishes across Cornwall."
Councillor Mark Kaczmarek, Cornwall Council Cabinet member for housing, has criticised decision to appeal.
He said: "The parish council had two options to either accept the defeat or go to the court of appeal which is what they have decided to do.
"Lanner has chosen to throw more money away into this and it's a real shame and I am disappointed.
"The 25 homes for local people are very much needed. The majority of people in Lanner aren't bothered about this building. I think it is wrong to expose parishioners to this amount of expenditure when for example the public toilets are closed, this is where the money should be spent."

“Housing development is being forced upon local communities because the holy grail of 'afforadbale housing' seems to outstrip everything else. Who or what is local? The only way that affordable housing (which incidentally is different to local) can be delivered is through market subsidy ie you have to have loads of houses built before they can be viable. Meanwhile Cornwalls countryside disappears and we have more people and more features like a city.
Good on Lanner and Truro.”

“Maybe it will encourage more people to stand for Town and Parish councils. Most have vacancies and good people are needed as more and more responsibility for delivering local services is put on their shoulders. Instead of moaning about Parish Councillors all the time why don't people step up and get involved themselves...or it it just too easy standing on the sidelines throwing stones!
I would like to take Councillor Mark Kaczmarek to task over his comments. Just who is it that has reduced the funding for public toilets giving many local councils the choice of either taking on the cost and responsibility for running them or letting them close? It's a bit rich for a Cllr from CC to be castigating a local council over something they have removed funding for!”

“What gives these NIMBYs the right to waste taxpayers money on legal fees for pointless appeals. Let the local youngsters have a chance of owning their own homes. The only beneficiaries of this waste of time is the lawyers who are already rich and getting richer at our expense.”

“Lanner Councillors over blown egos wasting Cornwalls Taxpayers money and Truro City Council are doing the same requesting a Judicial Review on the Waitrose Development. When you are spending thousands of pounds on making lawyers richer you should at least the publics permission first as they are picking up the costs.”

“Here we go again More council tax payers money being wasted because a parish council decides to get above itself, and not think of the people in their area that need these houses. The council tax payers of Lanner are going to have to pay twice for this debacle, once for the parish council fees and again for Cornwall council fees, common sense needs to prevail here. I hope that the residents of Lanner will be told the truth of how much this is going to cost them when these idiots stand for re election in May, but I doubt it.”
